BEERBOX LLC is a company registered in USA (collectively referred to as "BEERBOX", "we" or "us" in this overview). By accessing or using this Site, purchasing our products or using our subscription service (collectively referred to as “Products” or the “BEERBOX Service”), you agree to be bound by all of the terms and conditions in, and linked to, these Terms of Service (the “TOS” or the “Agreement”). If you do not wish to be bound by this Agreement, then you may not access or use this Site or purchase any Products. You must exit this Website immediately if you do not agree to the Terms and Conditions or are not of a legal age (21+) for consuming alcoholic beverages. BEERBOX reserves the right to change, modify, substitute or remove, without notice, any information on this Site as necessary. Your continued use of the Website or purchase of any product from us through the Website after such revisions are posted will constitute your agreement to such changes.

Limitations

The BEERBOX website, service and product is strictly not available to:

Minors under the age of 21;
Individuals that reside in a state or county that restrict shipment;
Those who cannot enter into binding contracts; and
Those outside the US.

This applies to the purchaser as well as the end recipient. Any found to be in non-compliance will be met with the fullest extent of the law.

If you do not qualify, you may NOT use the BEERBOX website, service or product.

Copyrights, Trademarks and Other Proprietary Rights

You acknowledge and agree that all content and materials available on this Website, including but not limited to trademarks, designs, logos, names, text, images, audio and video materials (the “Proprietary Material”) are the property of BEERBOX unless otherwise noted. BEERBOX’s Proprietary Material is protected under the intellectual property and other laws of the United States, individual states, and other countries throughout the world and under international treaties. You may not remove any copyright or other proprietary notices from BEERBOX’s Proprietary Material. You may not display, reproduce, distribute, modify, transmit, or otherwise use BEERBOX’ s Proprietary Material in any way for any public or commercial purpose, without the prior and express written consent of BEERBOX.

Licensing

Except with respect to the limited license to download and print certain material from this Website for non-commercial and personal use only, as set forth above in the section entitled "Use of Materials," nothing contained on this Website shall grant, whether by implication or otherwise, any license or right to use any of BEERBOX's Proprietary Material. All rights, title and interest in and to all aspects of BEERBOX's Proprietary Material remain the exclusive property of BEERBOX LLC.

Orders

This Agreement with any additional terms on this Site shall govern any order you make through the Site or Services for Products. BEERBOX ships only to select addresses in the USA. Your placement of an order through our Site is an offer to purchase the Product(s) ordered and we may accept your order by processing your payment and shipping the Product(s). For any reason, including errors of products on the Site, we may decline to accept your Order or any part of your Order.

The Products will be at your risk from the time of delivery. Ownership of the products passes to you on delivery. We encourage responsible use.

Free Products [coasters/stickers]

Each box may contain a small variety of coasters & stickers. These are adjunct to the core product and carry no intrinsic value. These prints (coasters/stickers) are given for free with each BeerBox. While these may be considered an advertising and promotional item, we further warrant that these prints are purchased directly from the manufacturer. With no direct link or relationship to each respective brewery.

Age Restriction

We will only supply alcohol-based beer products to persons who are over the legal age, which is 21 years old in the USA and otherwise in full compliance with the law. We will not supply to states or locations that may not accept such shipments.

By placing an order on this site and completing the order process which forms part of the contract of sale you thereby confirm that you are over 21, and that someone over the age of 21 will be available to accept delivery at the delivery address provided for your order, and that delivery will not be accepted by any person under 21 at that address. This also applies in that the end recipient must be 21 years or older. You hereby consent to have your identification checked upon delivery for compliance. You further warrant and confirm that where you are placing an order on this site as a gift to be delivered to any other person as a giftee, that the giftee is over the age of 21. BEERBOX does not allow its product(s) in the hands of minors does not accept any liability whatsoever for unlawful delivery to or acceptance by any person under 21.

Returns

Due to state regulations, we are unable to accept the return of any alcoholic beverages purchased by a customer. Please contact for more information.

End User Location

Not all states/counties allow you to accept our product. If you reside in an area that cannot accept our product, you are not allowed to purchase or participate. Our system is constantly updated and will reject all non-compliance.

Violations/Law

Any attempts to knowingly circumvent the age restriction, location restrictions, supply to a minor, or otherwise may result in legal consequences and met with the full extent of the law in your governing area. Your information and IP address will be forwarded.

Shipping Terms
By placing an order the buyer guarantees that he or she is at least 21 years of age and they will be responsible for the product being received by a person at least 21 years of age. Our products will not be released to those under the age of 21, verified by proof of identification upon delivery. All goods are sold as an “as-is where-is” basis in the state of Illinois and the title is passed to the buyer at the time of sale. All shipping costs are to be paid by the buyer. By placing an order you authorize BeerBox to act on your behalf to engage a common carrier/shipper to deliver your order to you. The Buyer is reminded that various states impose limitations on the quantity of alcoholic beverages, which may be purchased and brought into their jurisdiction without requiring the purchaser, the seller or the shipper to possess certain licenses or permits. BeerBox and the subsequent common carrier/shipper make no representation, assume no obligation and bear no responsibility whatsoever in applying or obtaining any such permits or licenses. The buyer warrants that they are aware of all laws and/or regulations regarding their shipment and take full responsibility to accept said shipment to their location. The Buyer is further responsible for all applicable excise, use and sales taxes due their state related to the purchase of any taxable goods. BeerBox makes no representation, express or implied, to the legal rights of anyone to purchase, ship or import beverages containing alcohol into any jurisdiction.

Payment, Product & Services

By submitting your payment information to us, you authorize us to charge you via the applicable payment method at our convenience. Single purchase Gift Boxes authorize us to bill once, in which a single non-recurring box will and ship once. Month to month customers hereby authorize us to charge you and take payment each month until you have cancelled your membership in accordance with this contract. Typical recurring payments will debit within the first few days of each month. Month to month boxes typically ship in the middle of each month. You represent that you will not use any form of payment unless you have all necessary authorization to do so. To pay for an order, you will need to provide BEERBOX with the information necessary to process an order from you, including your shipping address and the billing information requested on the Site to pay for such order. We can only accept payment in US dollars.

In the unlikely event that your payment card is used fraudulently to make a purchase with BEERBOX, you, the consumer, are entitled to cancel the said payment(s) if the product has not shipped. Please contact us directly.

Where we have validly taken payment in consideration of providing Products under this contract and where the Customer obtains a repayment from their credit card provider (“also known as a Charge Back”), notwithstanding such Charge Back, the Customer shall remain liable to us for such sums if deemed necessary.

We reserve the right to change the BEERBOX offerings at any time, including the pricing, frequency, quantities of beer in each shipment, products offered and more. Once you subscribe we will notify you any significant changes have been made.

Cancellation

Month-to-month members can cancel their BEERBOX membership at any time with no cancellation fees. This can be done by either:

Cancelling via account login
Cancelling via contacting support@beerbox.com - Sufficient details must also be supplied to identify your account.

Cancellations occur immediately and apply to any upcoming and future payments. If a monthly payment has already been made but you have not received product, due to processing you will still receive that month’s box. Full cancellation will take effect for the next month’s subsequent payment/box.

Disclaimer of Warranty

All content, products, and services on the site, or obtained from a website to which the site is linked (a “linked site”) are provided to you “as is” without warranty of any kind either express or implied including, but not limited to, the implied warranties of merchantability and fitness for a particular purpose, title, non-infringement, security or accuracy. Other than as required under applicable consumer protection law, under no circumstance will BEERBOX be liable for any loss or damage caused by a user’s reliance on information obtained through the site or a linked site, or user’s reliance on any product or service obtained from a linked site. It is the responsibility of the user to evaluate the accuracy, completeness or usefulness of any opinion, advice or other content available through the site, or obtained from a linked site. Please seek the advice of professionals, as appropriate, regarding the evaluation of any specific opinion, advice, product, service, or other content.

User Conduct

You are solely responsible for the content and context of any materials or information you post or submit through the Website. BEERBOX will fully cooperate with any law enforcement authorities or court order requesting or directing BEERBOX to disclose the identity of, help identify, or locate anyone transmitting any such content.

Indemnification

You shall indemnify, defend and hold harmless BEERBOX, its officers, directors, employees and agents (collectively, the "Indemnified Parties"), from and against any and all claims or demands made by any third party, and all associated liabilities, damages, costs and expenses (including but not limited to reasonable attorneys' fees) arising out of or relating to your browsing or use of this Website, content you transmit to this Website, your violation of any rights of another, or your breach of the Terms and Conditions. Termination

This Agreement constitutes a binding agreement between you and BEERBOX until terminated by you or BEERBOX, which BEERBOX may do at any time, without notice, in BEERBOX's sole discretion. If you become dissatisfied with the Website, in any way, your sole recourse is to immediately discontinue use of the Website.

Service

BEERBOX reserves the right to modify or terminate the BEERBOX Service for any reason, without notice, at any time. BEERBOX reserves the right to alter this TOS or other Site policies at any time, so please review the policies regularly. If BEERBOX makes a material change, BEERBOX will notify you here, by email, by means of a notice on our home page, or other places BEERBOX deems appropriate. What constitutes a “material change” will be determined at BEERBOX’s sole discretion, in good faith, and using common sense and reasonable judgment.

General Provisions

If any provision of the Terms and Conditions is held by a court of competent jurisdiction to be invalid or unenforceable, then such provision shall be enforced to the maximum extent permissible so as to affect the intent of the Terms and Conditions, and the remainder of the Terms and Conditions shall continue in full force and effect. The failure by either you or BEERBOX to exercise or enforce any rights or provisions of the Terms and Conditions shall not constitute a waiver of such right or provision.
